The commitment of the Spanish Bishops' Conference in favor of Transparency: the Transparency Portal and the Agreement with Transparency International España

ABSTRACT: This paper analyzes two recent measures adopted by the Spanish Bishops' Conference to increase its level of transparency. The first of these measures is the creation of a new Transparency Portal in which a great deal of information is collected on institutional, legal and economic aspects related both to the Spanish Bishops' Conference itself and to other entities of the Catholic Church in Spain. As the present article shows, it is possible to establish a parallelism between the information provided on that website and some of the active publicity obligations established by Spanish Transparency Act. The second of the measures analyzed is the Agreement signed by the Spanish Bishops' Conference and Transparency International España. Through this Agreement, the Spanish Episcopal Conference is committed to adopt measures to increase its levels of Transparency.

ABSTRACT: The article reconstructs the evolution of the protection of the historical-artistic heritage of the Catholic Church in Italy as a revealing index of ways of understanding the relationship between temporal dimension and spiritual dimension.

The reuse of places of worship: problematic aspects between canon law, civil law and administrative law

ABSTRACT: This article focuses on the juridical problematic aspects linked to the reuse of places of worship. It wants to examine the notion of “other grave causes” and “not sordid use” in canon law, the hypothecation as a place of worship and the choice of the more appropriate juridical instrument in the Italian civil law and the application of the Italian cultural heritage code, with the prohibition of destroying and of illegal use and the communication of the change in use, in administrative law. In conclusion, it is proposed a brief reference to the case studies and reflections from The future of churches, a conference that took place in Bologna, from 5th to 7th October 2016, and that was organized by the Department of Architecture at the University of Bologna and the Centro Studi Cherubino Ghirardacci.

ABSTRAC: The article is devoted to problems arising in implementation of the provisions of Federal Law from 30.11.2010 № 327-FZ (as amended on 23.06.2014) «On the transfer of property for religious purposes under state or municipal property to religious organizations». Ecclesiastical institutions in financial crisis. The role of “stable patrimony”

ABSTRACT : Within the economic framework coming from the 2008 financial downturn, many ecclesiastical institutions involved in commercial activities found themselves in severe financial crises, sometimes leading them to not be able to reimburse their debts. The enforcement of a classical bankruptcy law however does not seem to be fully tailored on these ecclesiastical institutions specificities. Indeed the current Italian bankruptcy law puts the ecclesiastical institutions assets under an indiscriminate attack that can seriously affect their survival and thus to ensure the satisfaction of the "religious" needs they exist for. In such a context, given the statement of the article 7.3, Law 121/1985 which emphasizes that the common law should be applied paying particular attention to the structure and the purpose of religious institutions, the present work attempt at developing a fist reflection on a specific canon law regulatory scheme, i.e. the "stable patrimony", which aim is to guarantee and protect a minimum assets useful to the survival of the ecclesiastical organization. After a first description and analysis of the "stable patrimony" profiles in a canon law perspective, the issue will be also addressed from the relevant point of view of the Church and State relations treaties.

Religious buildings and their appurtenances, land consumption and spending review.

ABSTRACT: In a pluralistic and multi-religious society marked by mass immigration. The territory is transformed and new presences also affect the enjoyment of the rights of religious freedom. In this new context, the places of worship take unusual functions and "utility": they perform the dual task of enabling the exercise of worship and serve as a gathering
place for the community. Particular importance have the liturgical and functional appurtenances of the building of worship which are often called upon to perform functions of social utility. To manage these spaces, public institutions as well as the Confessions, they resort to the instrument of conventions. This study analyzes the legal issues related to the structures of
worship, with reference to those owned by public bodies in the area and those that are part of the patrimony of the Confessions. Because they want to allow the exercise of rights on the territory, public bodies finance these activities under certain conditions and in a manner that, tailored to the Catholic Church, they extend their effectiveness in those with other denominations. The inclusion of church buildings in the area must deal with the limited financial resources of local authorities, intended for the maintenance and construction of them. Spending has to deal with the rational use of resources (spending review) through the review of the relationship between use of land and the use and enjoyment of existing buildings.
