Freedom and responsibility in the conjugal cohabitation: the stability of the divorce allowance after the exequatur of canonical nullity
ABSTRACT: In the recent ruling no. 9004 of 2021, the United Sections affirmed that the exequatur of the ecclesiastical judgment of nullity does not paralyze the trial on the economic effects of divorce, if the latter has already become unappealable. The ruling reveals a close link with the precedents of the Court no. 16379 of 2014 and no. 18287 of 2018, with a view to enhancing the effectiveness of conjugal cohabitation and the mutual responsibilities that are connected to it.

The Limits to the Practice of Worship during the Health Emergency and the ‘Responsible’ Collaboration with the Religious Denominations
ABSTRACT: The severe pandemic which has affected the Italian country (as well as the rest of the world) led the Government to introduce restrictive measures whose aim was to hinder the diffusion of the virus. Such measures imposed a general prohibition to any movements and gatherings, thus affecting the exercise of many fundamental rights and, among these, the freedom of worship, considered in its interpersonal dimension. In particular, as far as this right was concerned, the legitimacy of its restriction had to be assessed not only in the light of its balance with other competing interests (namely, public health), but even of the constitutional principle which compels the State to regulate its relationships with the religious denominations on the base of agreements signed whith their representatives (art. 7, c. 2, and 8, c. 3, Cost.). For these reasons, some scholars criticized the unilateral nature of the restrictive measures, whilst they welcomed favorably the signing of the ‘health protocols’ adopted in order to restart the celebration of public worship ceremonies. This paper aims at assessing whether a unilateral limitation of the freedom of worship might be considered legitimate. In addition, it is going to investigate the juridical nature of the abovementioned health protocols, in order to highlight any critical profiles.

The ʻAnti-veilʼ Ruling of Lombardy Executive Committee and the New Paradigm of Public Security
ABSTRACT: On 10 December 2015, Lombardy Executive Committee approved a ruling which forbids the access to some public facilities to people who wear types of clothing aimed at covering the face. This ruling, whose object is to prevent any dangers that could affect public security, risks to discriminate Muslim women who wear an integral veil for religious reasons. With a controversial judgement, the Milan Court of Appeal confirmed the legitimacy of the provision. Contrarily to the opinion of the Court, this essay aims at proving that the Regional ruling couldn’t effectively get through a proportionality test, given the excessive intensity of the prohibition. In addition, other doubts are risen by the meaning of public security expressed by the provision.

Again about the procedure of stipulation of the agreements (ʻinteseʼ) between the State and the religious denominations
ABSTRACT: The essay focuses on the topic of the agreements which should be subscribed by the Italian Government and the representatives of the religious denominations, in compliance with the article 8, c. 3, of the Italian Constitution. In a recent and highly controversial judgement, the Constitutional Court has recognised that the act of selection of the denominations for the negotiations aimed to the subscription of such agreements has the nature of a ʻpolitical actʼ and could therefore not be reviewed by any judges of the Country. The judgement has been deeply criticized by the most of the Italian scholars specialized in the subject. The object of this essay is to demonstrate that at least some parts of the complex procedure of production of the above mentioned agreements could not be considered ʻpoliticalʼ, in the technical sense, but should rather be reduced to the model of the typical administrative procedure. In that case, the Government acts of selection and of withdrawal from the negotiations could be object of a common administrative judicial review.
