Emotional relationships and legal border. Family and families in the European area from religious factors and national law to agreement strategies

ABSTRACT: The family is subject to socio-cultural changes and it is regulated differently from European legal systems. In addition, in Europe, by fall of geographical barriers and the increase of migration, there has been the spread of family models not compatible with the principles and values of the host countries resulting in legal, cultural and religious conflicts. The movement of people within the European area call for coordinated actions and/or the adoption of adaptation techniques processes to the recognition of family status and related rights. This process aims to avoid that one legal relations with internationality may undergone different and heterogeneous regulatory disciplines with implications on the effective enjoyment of fundamental rights and religious ones. This work analyzes the regulation of family law in the European judicial area to understand which path to follow in preventing that the movement of people may be hampered by the heterogeneous of national laws and the relevance of the religious factor in this context.

Integral ecological transition and religious discrimination of migrant women in the Mediterranean

ABSTRACT: In this essay it is hoped that the current development model will be overcome, because it is highly polluting and unfair from a socio-economic point of view, based as it is on competition and prevarication, the result of male hegemony in decision-making bodies and therefore discriminating for weaker and for women. These, on the other hand, must guide an integral ecological transition, because they are more inclined to the custody of creation and future generations, as well as to the improvement of the general living conditions of society, through sharing and dialogue, rather than with imposition and hard confrontation, as Pope Francis claims, in the encyclical Laudato si'. In particular, the ecological and social degradation caused by the androcentric system has increased the flows of migrants so-called environmental, which cross the Mediterranean Sea undergoing abuse and discrimination including religious ones. Above all, Muslim migrant women are more vulnerable also due to the misogynistic cultural heritage resulting from an erroneous and obsolete interpretation of the Koranic texts. Europe can be more involved in the fight against the negative consequences of climate change and discrimination against migrants, implementing policies inspired by sustainable development and intercultural solidarity, also with a view to fostering the ambitious and suggestive attempt to reach a integrated Euro-Mediterranean area.

Abstract: A resigning member who declares that he no longer wishes to be a member of the religious organization but at the same time does not wish to cease his membership of the same confession, is not liable to compensation for psychological and economic damage following the ratification of his resignation and its communication to the local faithful. According to the court, a member's resignation (an associative aspect) corresponds on a confessional level to no longer being considered a member of the confession. Therefore, the damaging nature of the public announcement is excluded. The general principles of law legitimize the actions of the religious organization, which also has constitutional protection in that the internal life of the religious body is regulated by its statutes, as no state interference is admissible. So-called ostracism on the part of members has no legal relevance, since it is rather the free choice of each individual to associate with someone or not, and this right is neither punishable nor harmful. The religious organization that suggests ostracizing behavior does not violate any rights as such teaching falls within the sphere of the lawful. The religious organization that suggests supposedly ostracizing behavior does not violate any legal norms, nor does it harm the interests of those who decides to cease his membership.

The discipline of the religious factor in the Church of England: perspectives on constitutional inclusivism

ABSTRACT: The Church of England reproduced the characteristics of national churches in which rulers were free to choose the religion to be professed and subjects obliged to observe it. This condition persisted until 1689 when William III of Orange passed an ʹact of tolerationʹ by which a certain religious freedom was fostered, albeit in embryonic form, effectively paving the way for the stabilization of the different sensibilities, theological and ecclesiological, present in the aforementioned ecclesial reality and currently converged in the High Church, Low Church and Broad Church. In this regard, it is worth recalling the positive factors that these components have offered to today's Anglican Church, among which the right of ecclesial reorganization, inclusivism and lay participation in ecclesiastical government undoubtedly stand out. In the latter direction, therefore, must be understood the Synodical Government Measure of 1969 by which a parallel constitutional structure, inspired by the revaluation of the synodal element, through which the ʹequalʹ participation of bishops, presbyters and laity in the potestas gubernandi was ensured in the Church of England, alongside the secular hierarchical chain that reaches from the sovereign down to the faithful, was introduced. Indeed, it is no accident that the Anglican Church "is episcopally led and synodically governed”.

The ministers of religion in Italian law

ABSTRACT: This contribution analyses the status of ministers of religion in the Italian legal system. It starts from a description of the historical foundations, which lies in Nineteenth-century liberal legislation, and arrives at a synthetic representation of the regulations currently in force in the unilateral State law and in the Concordat and Treaty legislation. The regulatory evolution, which is still in progress, describes the transition from a uniform and homogeneous concept of minister of religion, inspired by the Catholic priest and placed at the basis of a mostly restrictive legislation, to a more articulate and comprehensive one, reflecting the growing confessional pluralism of Italian society and the assertion of the right to religious freedom. This new approach represents the premise for a legislation that increasingly aims at protecting and promoting the status and the manifold activities of ministers of religion, particularly in the context of the strong enhancement of the Welfare State and of the Third sector. Finally, the article focuses on some problematic issues of the current legislation and on the apparent paradox that, in the face of a more favorable State legislation, nowadays the status of the minister of religion, and in particular that of the Catholic priest - who still represents the main reference for Italy’s legislation - is undergoing a strong identity crisis in the ecclesial order, thus posing a series of problems also for society at large.

Sustainability and environmental transition: the legal Buddhist contribution

ABSTRACT: We are currently experiencing an increasing attention on the economic sustainability and the environmental issues. This process still merely seems a theoretical declaration because its concrete efforts are appearing weak and fragile. The aim of this essay is to underline the possibility of a better comprehension of those sets of problems by studying the spiritual and legal contribution of Buddhism: a not theistic axiology that implies a renewed approach to ecology and economics, able to determine methodological consequences even in the sphere of public law.

ABSTRACT: In a controversy concerning the legitimacy of the wearing of the Sikh kirpan in the public space, the Italian Court of Cassation stated that immigrants have the obligation to conform their values to those of the Western world. This is but one case when a migrant’s religion has been assumed - in the public and political debate and in courts - to draw a line between what belongs to the Western civilization and what does not. This paper aims to challenge the ‘West versus non-West’ approach, by examining the interplay between religion, citizenship and migration, and by stressing that democratic countries are such only as long as they remain pluralist and accommodate diversity. Although limitations on unacceptable manifestations of religion do apply, these must pursue only legitimate aims under international standards, which do not include such a thing as the protection of Western values.

The Status of Oriental Catholics in Germany. A current challenge for the coordination of the two Codes

ABSTRACT: According to an estimate by the Secretariat of the German Bishops' Conference, about 200,000 members of fourteen different Eastern Catholic Churches currently live in Germany. A first large migratory wave with a lasting impact up to today emerged with members of the Ukrainian Greek Catholic Church in the first decades of the 20th century. Lately, due to migration from Syria and Iraq starting in 2015, a larger number of Eastern Catholics - estimated by some in the five-digit range - have arrived in Germany. The change brought about by migration poses new challenges for pastoral care and canon law in Germany. The Ukrainians have their own jurisdiction in the form of an Apostolic Exarchy. All other Oriental Catholics have been entrusted to local Latin ordinaries by a decree of the Congregation for the Oriental Churches according to can. 916, § 5, CCEO. Therefore, the solution of many legal questions requires a synopsis of both codes. Do Latin parish priests have the authority to celebrate marriages for Oriental couples per se? To which church do children from a mixed marriage belong? The motu proprio De concordia inter Codices did not answer all questions and has also brought new ones.

Quran and/or Sunna? Narrative and prescriptive function in the 'sources' of Islam
 
ABSTRACT: Even if in different forms and according to historical and anthropological factors that have conditioned their development, religions have a doctrinal part and precepts that can have different weight and priorities in each of them. Islam, which like Judaism is centered more on orthopraxis than on orthodoxy, over time and especially in the modern era, also in relation to the phenomenon of huge migrations of its faithful to the West, is faced with new challenges affecting its regulatory side. In this regard, various orientations and studies have long confronted each other and still animate a little-known debate outside the circle of specialists.
