Christian conception of history in Carl Schmitt’s Thought

ABSTRACT: The aim of this essay is to analyse the Christian conception of history in Carl Schmitt’s thought, already developed in his previous works, but again recalled and reworked in the 1950s, in order to hinder the technological drift of society. In particular, in outlining this new and different temporal horizon, Schmitt, on the one hand, recalled the solitary and prophetic intuitions of Donoso Cortés and, on the other, the mysterious figure of the katéchon, or rather, one of the most meaningful concepts of Schmitt’s theological-political Weltanschauung.

Mutual Collaboration in the Service of the Human Person between the Catholic Church and States after the Second Vatican Ecumenical Council and the Villa Madama Agreements

ABSTRACT: The article examines the ways of expressing the sana cooperatio between the Holy See and the political community in the aftermath of the Second Vatican Council and the Villa Madama Accords. It will focus on the its characteristic traits as emerging from the pontificates of John Paul II, Benedict XVI and Francis and then examine the instruments of cooperatio, in particular the role of the Secretariat of State, the papal nuncios and the concordats.

Principle of non-discrimination on the grounds of religion in EU law and national approaches to the "neutrality" of the public employee 

ABSTRACT: For the first time, the Court of Justice of the European Union has been called upon to give a preliminary ruling on prohibition on wearing visible signs of political, philosophical or religious belief imposed by a public employer, from the perspective of the principle of non-discrimination on the grounds of religion enshrine in the Council Directive 2000/78/EC of 27 November 2000 (establishing a general framework for equal treatment in employment and occupation). After a look at principles of State neutrality in France, Germany and Belgium, the paper examines this issue by taking a cue from the Conclusions presented by the Advocate General in case C‑148/22. According to the Author, national identity, to which Article 4(2) TEU refers, leaves in this particular sector a wide margin of discretion to the Member States.

Environmental protection in the Catholic social teaching

ABSTRACT: This short essay aims to analyse the evolution of the Catholic social teaching regarding environmental protection. Starting from a famous article by T. Lynn White in 1966, the Judaic-Christian doctrine on the men-nature relationship has been frequently qualified as a strongly anthropocentric one, being also considered as an ideological premise of men's exploitation of the environment and, as a consequence, of the actual ecological crisis. This contribution, moving from the analysis of the Catholic social teaching on environmental safeguard and of some relevant theological, historical and social issues, explains why this idea needs to be rejected and try to imagine which role the Catholic Church, and Christianity in general, can have in facing the environmental crisis in the future.

The blanket of silence: fears and hopes

ABSTRACT: The silence of the parties governing the country and those belonging to the opposition persists. Their political orientation on the 'ecclesiastical matters' is yet to be shared, as well as their position on the need for a more general law on religious freedom. The new conservative government keeps silent. There are signs of a possible failure to comply with the pluralistic principle, which is the cornerstone of the secular nature of the State. Between hopes and fears, the latter could prevail.

ABSTRACT: The work reconstructs the transition from hate speech to hate crime, through a reconstruction of comparative and supranational law, highlighting the difficult balancing of interests that underlies it with the related problems of the taxability and determinacy of the incriminating case.

Re-thinking social inclusion in the sustainability’s perspective

ABSTRACT: This essay critically discusses some theoretical problems related to the relationship between social inclusion and sustainability. In particular, it highlights that this is a two-way relationship that takes place within the representation of a concrete universal. The reflection is divided into three moments: first, the concept of sustainability is investigated in relation to the idea of future and then the concept of inclusion is investigated in relation to both identity and participation.

Emotional relationships and legal border. Family and families in the European area from religious factors and national law to agreement strategies

ABSTRACT: The family is subject to socio-cultural changes and it is regulated differently from European legal systems. In addition, in Europe, by fall of geographical barriers and the increase of migration, there has been the spread of family models not compatible with the principles and values of the host countries resulting in legal, cultural and religious conflicts. The movement of people within the European area call for coordinated actions and/or the adoption of adaptation techniques processes to the recognition of family status and related rights. This process aims to avoid that one legal relations with internationality may undergone different and heterogeneous regulatory disciplines with implications on the effective enjoyment of fundamental rights and religious ones. This work analyzes the regulation of family law in the European judicial area to understand which path to follow in preventing that the movement of people may be hampered by the heterogeneous of national laws and the relevance of the religious factor in this context.
