Educational Institutions in the Italian Constitution

ABSTRACT: According to the current Constitution, Italy presents itself as a pluralist and participatory democracy, in which certain functions aimed at enhancing the human person are not taken directly by the State – except in exceptional cases in which the public authorities intervene, for reasons of necessity, in a subsidiary or supplementary way – but they are normally assigned to specific social subjects (or formations), among which the educational institutions have a special and qualified position. The present contribution intends to highlight that the Italian “social State” does not present itself as a “educating State” in its own educational models that the public structures impose in an authoritarian way on the single components of the national collectivity. On the other hand, the Italian Constitution, in recognizing social relevance to the educational function, assigns its concrete management to certain “"pedagogical agencies” or “educational institutions” operating autonomously within the civil society: among which the qualified family holds a qualified position. School and religious confessions. They do not operate in the name or on behalf of the State, but operate within a framework of legal, cultural and institutional guarantees and pluralism, within a normative framework dictated in this regard by the constitutional text and by ordinary legislation. By carrying out the special role assigned to them by the Italian legal system, educational institutions participate in the democratic dynamics of the country, contributing with their work to the construction and evolution of the civil and national community.

Son passati quasi trent’anni dacché tra le varie dichiarazioni apposte in calce al trattato di Maastricht comparve abbastanza inaspettatamente quella che impegna l’Unione Europea al “dialogo trasparente, costante e regolare” con “le chiese e le associazioni o comunità religiose” non più e non meno, tuttavia, che con le “organizzazioni filosofiche e non confessionali”. Dichiarazione apparentemente innocua, giacché espressamente si esclude che da essa possa essere pregiudicato lo status a quelle organizzazioni assegnato dai diritti nazionali, ma politicamente impegnativa per l’Unione, tanto che fece strada e si riversò nell’art. 17 del TFUE, assumendo così un carattere anche giuridicamente impegnativo. Non-believer’s Europe

ABSTRACT: In spite of the Treaty on the Functioning of the European Union, which puts on the same footing the status of the churches and of the humanist organizations, the status  of believers and non-believers is not the same in each state, regardless its model (the paper quotes briefly the features of United Kingdom, France, Belgium, Italy, Germany  and Malta). The reason lies in a kind of mass religious tradition, which at present is even more hard to defeat because of the rampant populism, which takes advantage also of the religion. The antidote stays in the pluralistic – not monist and excluding the differences -  secularism in order to grant the same dignity of believers also to both differently believers and non-believers.

Collective religious freedom and principle of non-discrimination in the ‘constitutional’ system of the European Union

ABSTRACT: In the two recently handed down Judgments in the cases Vera Egenberger and JQ, the Court of Justice of the European Union for the first time interpreted Article 4, par. 2 of the Anti-discrimination Framework Directive (Directive 2000/78/EC) admitting a ‘religious exemption’ in favour of Churches and other religious organisation, and ruled on the horizontal application of the right not to be discriminated against in situations coming within the scope of EU law. The paper explores the substantive implications of those Judgments for the collective religious freedom and their contribution in clarifying the horizontal direct effect of the fundamental rights and principles enshrined in the Charter of Fundamental Rights of the European Union.

Religious dietary rules and school lunch menus: a challenge for secularism?

ABSTRACT: The paper starts from a case of dietary pluralism to discuss the possibility to justify menus sensitive to different religious dietary rules in schools’ canteens. Building on an analysis of the idea of secularism, both in its legal interpretation and in its philosophical understanding in terms of neutrality, I try to show that providing for menus sensitive to different religious dietary rules does not amount to a breach of secularism; it is, rather, a legitimate consequence of the protection of individuals’ rights to freedom of conscience and religion. Moreover, whenever institutions take action to devise and implement such menus they can be taken to act on a commitment to respecting the beliefs of minority groups in society without expecting that these groups, which are often migrant communities suffering of well-known problems of social integration, take on the burden to put forward public claims.

Il 28 settembre 2018, presso l’Università degli Studi di Milano-Bicocca, si è tenuto un convegno internazionale co-finanziato dall’Unione Europea, che ha visto la partecipazione di giovani studiosi delle più diverse discipline giuridiche, italiani e stranieri. I relatori, selezionati in seguito ad una “call for papers”, cui è stata data ampia pubblicità in Italia e all’estero, si sono confrontati sul tema del pluralismo religioso nel sistema europeo e, soprattutto, nella recente giurisprudenza delle Corti sovranazionali. Neutrality, diversity and celebration of religious festivities in public schools

Abstract: This paper analyzes some legal conflicts derived from the celebration of religious festivities in ​​the public school. On the one hand, the celebration of certain festivals that, while showing a cultural tradition, at the same time, present a religious meaning, mainly of Christian inspiration. On the other, when permission is requested to celebrate and commemorate such festivities during school hours. Beyond the concrete problem, it is important to start from the position of inclusive neutrality that public authorities must adopt to manage the religious diversity that manifests itself in this specific area and which, in turn, is the best way to guarantee the right of parents to choose the education they wish for their children.

The origins of the Christian fundamentalism: comparative approaches and research perspectives

ABSTRACT: The aim of this essay is to demonstrate the Christian roots of the public discourse concerning fundamentalism, its disciplines, groups and legal consequences. This issue implies to go back to the first Christian fundamentalist experiences born and raised during last two centuries in America (with a peculiar focus on the United States). By reconsidering a wide historical period and a not simple variety of local religious communities, it will be possible to underline a substantial and concurrent beginning for similar movements in the progressive development of Jehovah’s Witnesses, new wave Lutheran and Baptist Churches, Church of Latter Day Saints: some of the same faiths and cults still effecting the American recent ecclesiastical controversies.

The Protestant Influence on the Church Reform of Peter the Great

ABSTRACT: Peter the Great first comes into contact with the outside world through long familiarity with the German Quarter, a fluctuating Muscovite community of foreigners with its Lutheran and Calvinist churches, and with subsequent and extensive travel in the Protestant Lands (1697-1698), where he has ample time to appraise the role of sovereign as head of the church. The relationship of the tsar to his church is paradoxical; on the one hand, it emanates laws contrary to the principles sanctioned by the Church's Councils and organizes blasphemous parodies with The All-Joking, All-Drunken Synod of Fools and Jesters; conversely, he imposes rigidly traditional religious behaviors on the military. Rejecting his role and duty as Servant of the Salvation of Souls, he assumes a secular stance: Protector of the wellbeing of the community, (Vsenarodnaja pol’za). This swerve subordinating Church to sovereign undergoes elaborate scrutiny by Feofan Prokopovyč, apologist and theologian with Protestant leanings, who, in light of the abolition of the Patriarchate and the institution of the Holy Synod, affirms the principle of cuius regio eius et religio, openly challenging the position of the locum tenens Stefan Javors’kyj.
