New Frontiers of Culturally Motivated Crimes. The Intercultural Method-Approach as a Tool to Prevent and Counter Religion-Inspired Crimes

ABSTRACT: This paper analyses the so-called culturally motivated crimes, focusing the attention on legal measures that may prevent and counter such misconducts. The Author points out some methods, such as those referring to the transformative accommodation, which may be able to solve conflicts between the need to safeguard human rights, including those related to religious freedom, and the Government's priority to protect public safety. From here stems the investigation on the so-called Islamic terrorism that, under some aspects, can be seen as a new frontier of religion-inspired crimes. This, on the other hand, suggests a multisectoral approach, which is important in order to deal with very serious threats while promoting intercultural and inter-religious integration.

ABSTRACT: This article analyses the debate concerning the legal status of same-sex unions, also considering what the Italian State Council has affirmed in relation to the possibility of recognising a same-sax couples (who have got married abroad) in Italy. In this respect, the author investigates the national and European jurisprudence, which has in fact influenced the decision of administrative Courts, including that of the said State Council. The attention is particularly focused on the most interesting passages of the State Council’s judgment, from both the legal point of view and the methodological approach.

ABSTRACT : This paper examines a recent decision of the Italian State Council relating to the life-sustaining treatment and advance directives. This decision - which is notable for having shared a secular notion of "health care" - does not fail to emphasize the need for an incisive intervention of the national law that aims at regulating the so-called "good death".

ABSTRACT: This essay regards the new professional status of teacher's religion in public school, in the light of juridical discipline approved in 2012. It analyses the rules as well as the abundant case-law in this field, underling the trend that considers the cultural value of catholicism teaching in public school in respect to the context of religious and social pluralism.

ABSTRACT: This paper analyzes the phenomenon of conscientious objection, with particular reference to the voluntary interruption of pregnancy. The author analyzes the different legal interpretations, concluding that the prevalence of a restrictive interpretation of the institute, which permits only objection to the interruption of pregnancy and excludes, therefore, all preparatory and subsequent surgery.

ABSTRACT: With this essay the Author analyses the way hospitals, managed by religious organizations (from here stems the Italian notion of so-called “ecclesiastical hospitals”), act in respect to the health care system, which in Italy is informed by the principle stated in article 32 of the Constitution: this principle affirms that “the Republic safeguards health as a fundamental right of the individual as a collective interest”. In particular, the Author is able to demonstrate that the integration process concerning the ecclesiastical hospitals can be considered either a result of the principle of “Subsidiarity” (in the horizontal sense of the term) or a product of the important role that, in Italian legal system, has been traditionally recognised to the religious groups, in primis to the Catholic ones. Despite a legal context more and more secularised, in Italy religion still plays a crucial role, especially in fields related to the common wealth. In this manner, with their organizations, religious groups can help the State in affirming and protecting the constitutional “values”, including those values which were stemmed from to secular roots.

ABSTRACT: With this essay the Author analyses the characteristics of religious freedom in Nigerian legal system, which is considered part of a wider legal phenomenon, what is called the African legal system. Considering the issues related to the religious attitude of the African peoples, and in particular that of the Nigerian ones, the Author underlines the influence exercised by the various religious creeds on other spheres of public life. Besides, in this context one has to take into account the fact that both traditional cultures and political framework have been deeply influenced by the British colonial power. Finally, in this essay the Author also analyses some aspects concerning the fundamental rights in Nigeria, including the religious rights: the way these rights have been recognised and implemented in Nigerian legal system.
